GDPR information for applicants in connection with recruitment
at HARIBO Lakrids A/S and HARIBO Produktion A/S

1. PROCESSING OF PERSONAL DATA DURING RECRUITMENT
The purpose of collecting personal data about you during the recruitment process is to determine whether you are a qualified candidate for a vacant position at Haribo Lakrids A/S or HARIBO Produktion A/S.

When you apply for a position with us, we receive, register and process a variety of personal data about you. We are the data controller of the personal data that we receive, register and process about you.

We process ordinary personal data about you in connection with the hiring process, but we may also process special categories of personal data, your personal identification number or other data such as data about criminal offences.

2. WHEN WE RECEIVE YOUR APPLICATION
In the recruitment process, we register the personal data in your application, CV and other accompanying documents.

Typically, this includes the following data: Name, address, date of birth, gender, telephone number, e-mail address, personal identification number (‘CPR number’), marital status, educational qualifications, courses, certificates, examination marks, career history, driving license information, recommendations and/or references, and test results/profile (if you are tested).

Our legal basis for this processing is the General Data Protection Regulation’s Article 6 (1) (b), as this is personal data that you yourself have provided us for the purpose of being hired by us in order for us to comply with the terms of the employment contract.
The data you provide us is registered in our recruitment system (Visma EasyCruit).

3. WE ASSESS THE APPLICATION
We specifically assess each applicant's qualifications in relation to the position advertised. Once we have read the applications, we select candidates for job interview(s). Candidates who have not been called in for an interview will be notified.

4. WHEN WE HAVE SELECTED YOU FOR A JOB INTERVIEW
In connection with the job interviews, we will receive additional data about you which we will note for use in the further recruitment process.

Our legal basis for this processing is the General Data Protection Regulation’s Article 6 (1) (b), as this is personal data that you have informed us about for the purpose of being hired in order for us to comply with the terms of the employment contract.

5. INFORMATION FROM SOCIAL MEDIA
When recruiting for positions with a focus on customer and partner relationships, it may be relevant for us to conduct a search on social media (LinkedIn, Facebook and Instagram).

We use the provision on legitimate interests in the General Data Protection Regulation’s Article 6 (1) (f) as the legal basis for obtaining data about candidates from social media. We do this to be able to assess whether you have a profile that fits the company and the specific position.

6. CRIMINAL RECORD
Some positions require the candidate to provide a criminal record. We assess whether a criminal record is required in relation to the responsibilities and duties of each position. The purpose is to safeguard the best interests of the company.

We only request a criminal record from candidates who have been offered a position with us. When we receive a copy of your criminal record in connection with the hiring process, we will delete it as soon as we have registered that we have seen your criminal record.
We use consent in accordance with Section 8 (3) of the Danish Data Protection Act as the legal basis for this. You can withdraw your consent at any time. You can do so by contacting us through the above contact details. If you withdraw your consent, it will only enter into effect from the time of withdrawal. Therefore, it does not affect the lawfulness of our processing of your data up until the moment you withdrew your consent.

7. INFORMATION FROM PREVIOUS EMPLOYER
Some positions require obtaining references from previous employers. If we obtain references from one or several of your previous employers, we will record the data we receive.
We use your consent under Article 6 (1) (a) of the General Data Protection Regulation as the legal basis to process this data, and you will therefore be asked to provide your consent before contacting one or several of your previous employers. You can withdraw your consent at any time. You can do so by contacting us through the above contact details. If you withdraw your consent, it will only enter into effect from the time of withdrawal. Therefore, it does not affect the lawfulness of our processing of your data up until the moment you withdrew your consent.

8. RESIDENCE AND WORK PERMIT
Candidates who wish to work for us must have a valid work and residence permit. To verify this, we may ask for a copy of your passport in connection with the hiring process.
If, due to your citizenship, you must have a work and residence permit to legally work in Denmark, we will also request a copy of your work and residence permit.

We use Article 6 (1) c of the General Data Protection Regulation as the legal basis for obtaining a copy of your passport (and work and residence permit, if applicable), as we are statutorily obligated to do so in accordance with Section 59 (5) of the Danish Aliens Act.

9. DRIVING LICENCE
If you will be working in a position that requires driving on company business or in a company car, we will also request a copy of your driving license.

10. STORAGE AND DELETION
If your application is rejected, we will delete the data we have registered about you after 6 months have passed.

If you are hired, we will store the data that was part of the recruitment process in your personnel file.

If we received a copy of your criminal record in connection with the hiring process, we will delete it as soon as we have registered that we have seen your criminal record.

There are situations where we may want to save your application even if it was rejected for the purpose of future recruitment. If we want to save your application, we will ask for your consent to do so.

11. YOUR RIGHTS
The provisions of the General Data Protection Regulation and the Danish Data Protection Act give you a number of rights.

If you wish to exercise any of your rights, contact HR.
• Right to access data (right of access), Article 15
• You have the right to access the data we process about you as well as other information.
• Right to rectification, Article 16
• You have the right to have incorrect data about yourself corrected.
• Right to erasure, Article 17
• In special cases, you have the right to have data about you deleted before the our ordinarily scheduled deletion of that data.
• Right to restrict processing, Article 18
• In some cases, you have the right to restrict the processing of your personal data. If you have the right to restrict the processing of your personal data and choose to exercise that right, we are subsequently only allowed to process the data - with the exception of storage - with your consent, for the purpose of establishing, enforcing or defending legal claims or protecting a person or vital public interests.
• Right to object, Article 21
• In certain cases, you have the right to object to our otherwise lawful processing of your personal data.
• Right to transmit data (data portability), Article 20
• In certain cases, you have the right to receive your personal data in a structured, commonly used and machine-readable format and to have this personal data transferred from one data controller to another without hindrance.
